Terms and conditions

The agreement between you and Gymist Ltd. Using the site means accepting it, so it is written to be read rather than skipped.

Who this is between

Gymist Ltd (“Gymist”, “we”), a company registered in England and Wales under number 13669059, runs gymist.co.uk. These terms apply to everyone who uses it, whether or not you have an account. If you do not accept them, please do not use the site. How we handle your information is in our privacy policy, which forms part of this agreement.

Gymist is free

There is no charge to use Gymist, no membership fee, no premium tier and no plan to add one. Claiming a gym listing is free too. Nothing on this site asks you for payment, and if something ever does, it is not us.

You have to be 16

Gymist is for people aged 16 and over. People arrange to meet each other through it, and that is not something we are willing to open to children. We will close an account we find belongs to someone under 16.

Your account

You sign in with a link sent to your email address, so there is no password to lose — but the link is as good as one. Keep your email account secure, do not forward sign-in links, and tell us straight away if you think somebody else has got into your account. You are responsible for what happens under your account where that follows from not keeping it secure. Do not use anybody else’s account.

One account per person. Do not pretend to be somebody else, do not use a name or photo that belongs to somebody else, and do not create an account to get around a block or a suspension.

Meeting people

This is the part to read properly. Gymist introduces people; it does not vet them. We do not verify identities, we do not carry out background checks, and we cannot know whether somebody is who they say they are or whether they will behave well.

If you arrange to train with somebody you met here, that arrangement is between the two of you and you make it at your own risk. Meet somewhere public, tell somebody where you are going, and stop if something feels wrong. Block and report anyone who makes you uncomfortable — blocking is invisible to them, and reporting comes to us.

Not medical or fitness advice

Gymist is a directory and a place to find people, not a source of medical or professional advice. Nothing on the site — including articles, reviews and anything another member tells you — is advice about your health, and none of it substitutes for a doctor or a qualified coach. Training carries risk, and how you train is your decision.

What we say about gyms

Our gym listings are put together from public sources, from operators, and from members. Opening hours change, facilities close, and prices move. We work at keeping it right and we cannot promise it is. Check anything that matters with the gym before you rely on it, and tell us when you find something wrong.

How to behave here

Do not use Gymist to:

  • harass, threaten, bully or stalk anybody, or contact somebody who has made clear they do not want to hear from you;
  • attack people for their race, religion, sex, gender identity, sexual orientation, disability, age or nationality;
  • post sexual content, or approach anybody sexually who has not invited it;
  • advertise, recruit, spam, or sell anything;
  • post anything unlawful, defamatory, or that is not yours to post;
  • share somebody else’s personal information, or photographs of people who have not agreed to be photographed;
  • impersonate anybody, including us.

Reviews are first-hand or they are nothing. Write about a gym you have actually been to. Do not review your own business, do not review a competitor, do not accept anything in exchange for a review, and do not post the same review more than once.

What you may not do to the site

Do not scrape, crawl or bulk-copy the site or its content by any automated means beyond ordinary search engine indexing. Do not try to get into any part of the site, account or system you are not entitled to. Do not probe or test our security, do not interfere with how the site works for other people, and do not place an unreasonable load on it. Do not try to trace another user or work out who they are from what the site shows you.

What you post stays yours

You own what you write and upload. You are responsible for it, and you confirm that you have the right to post it and that posting it breaks nobody else’s rights.

So that we can actually show it to people, you give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, adapt for display, and publish your content for the purpose of operating and promoting Gymist. That licence ends when you delete the content or your account, except that we may keep copies in backups for a limited period, and we cannot recall copies other people have already made.

We do not sell your content, we do not license it on to anybody else for their own purposes, and we do not use your name, photograph or likeness in advertising without asking you first.

Where your content is public — reviews and articles are — other people can see it, search engines can index it, and it can be quoted. Think about that before you post.

What belongs to us

The design, code, text, graphics, logos and the arrangement of the site are owned by or licensed to Gymist and are protected by copyright and trade mark law. Third-party names and logos appear for identification only. You may not copy, republish or redistribute any of it for commercial purposes without our written permission — reading it, linking to it and sharing an ordinary link are all fine.

Claiming a gym

If you claim a listing you are confirming that you own or are authorised to represent that business. We may ask you to prove it and we may withdraw a claim we are not satisfied with. Claiming a listing does not give you the right to remove honest reviews.

Moderation, and when we step in

We can remove content, restrict features, suspend an account or close it — for a breach of these terms, or where somebody’s safety is at stake. We try to be proportionate and to say why. Where the reason is safety, we may act first and explain afterwards.

You can close your account yourself at any time, from your account settings. Our privacy policy sets out exactly what that deletes and what it does not.

We may pass information to the police or another authority where we are required to, or where we believe it is necessary to prevent harm.

Links to other sites

We link to gym websites and other places on the internet as a convenience. We do not control them, we do not endorse them, and what happens on them is between you and whoever runs them.

What we do and do not promise

We provide Gymist as it is. We do not promise the site will always be available, that it will be free of faults, or that anything you find here will produce a particular result. We may change, suspend or withdraw any part of it, and we may need to interrupt it for maintenance.

Gymist is provided for personal, non-commercial use. If you use it for business purposes, we exclude the implied terms and remedies that would otherwise apply to that use.

Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. Your statutory rights as a consumer are not affected.

Subject to that, we are not liable for:

  • what other users do — on the site, in messages, or in person after meeting through it;
  • anything you do or do not do as a result of information on the site;
  • loss that was not reasonably foreseeable when you started using Gymist, including lost profit, lost business or lost opportunity.

If your use of Gymist costs us

If somebody brings a claim against us because of something you posted or did on Gymist that broke these terms or the law, you agree to cover the reasonable costs we actually incur as a result. This does not apply to anything caused by us.

Changes to these terms

We may update these terms. The date at the bottom tells you when they last changed, and where a change matters we will tell members about it rather than relying on you noticing. Continuing to use the site after a change means you accept it; if you do not, you can close your account.

Law and jurisdiction

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts.

If any part of these terms turns out to be unenforceable, the rest of them still stand.
